PUBLIC CALL No. 01/24

FOR THE COLLECTION OF BIDS FOR LEASING OF REAL ESTATE – LAND FOR THE PLACEMENT OF A TEMPORARY FACILITY – A SUMMER GARDEN FUNCTIONING AS A CATERING FACILITY

 

The subject of this Public Call is to collect bids for the leasing of real estate (land) for the placement of a temporary facility – a summer garden serving as a catering facility for restaurant activities and mobile catering units – cafe bars and pizzerias. The area in question is 59 m2, registered on cadastre parcel number 417/2, listed in Land Register No. 186 KO Podgorica, located at ulica 13. jula.

 

The minimum (starting) amount for the annual lease is set at €2,832.00, excluding VAT. The lease payment is to be made in full upon the signing of the lease agreement for the property - land.

The property described in item 1 of this Public Call is offered for lease for a fixed term of three years, with the possibility of extending the contract in accordance with the law.

The property in question is being leased for the purpose of placing a temporary facility – a summer garden functioning as a catering establishment for restaurant activities and mobile catering units – cafe bars and pizzerias. The arrangement for placing the temporary facility will be defined in the Lease Agreement and urban-technical conditions.

The Public Call is open from the date of publication in a daily printed media distributed throughout Montenegro and on the University of Montenegro website www.ucg.ac.me, up until April 23, 2024, 14:00 hours.

BIds are to be submitted by direct delivery in a sealed envelope, labeled "For Public Call No. 01/24 - DO NOT OPEN BEFORE PUBLIC OPENING OF BIDS", to the address: Rectorate of the University of Montenegro, Podgorica, Cetinjska No. 2, archive office, every weekday from 10 to 14 hours, concluding on April 23, 2024, by 14:00 hours.

Participants in the Public Call are required to deposit 10% of the bid value for the property described in item 1 of this Public Call, into the bank account of the University of Montenegro at Montenegrin Commercial Bank A.D. Podgorica, account number 510-10115-56, with the note "Participation in Public Call No. 01/24", and to submit proof of the paid deposit along with the bid in a sealed envelope. The cost of transferring the deposit is borne by the bidder.

If the bid is invalid or not accepted, the deposit will be returned to the bidder within seven days from the deadline for establishing the ranking list. The deposit paid by the bidder whose bid is accepted will be credited towards the lease payment. If the bidder whose bid is accepted fails to sign the contract within the specified period or fails to make the payment of the offered lease amount within the agreed period, they forfeit the right to the refund of the deposit.

The public opening of bids, which may be attended by the submitters of bids, their representatives, or attorneys, as per the attached power of attorney, will be held on April 23, 2024, at 15:00 hours, at the Rectorate of the University of Montenegro, Podgorica, Cetinjska No. 2.

Submitted bids cannot be changed or supplemented.

BIds may be withdrawn no later than three days before the expiration of the Public Call by submitting a written statement or sending written notification of the withdrawal of the bid.

Legal entities registered to conduct activities for which the property is being leased are eligible to participate in the Public Call.

Participants in the Public Call are required to submit along with the bid:

- Name and address of the companys headquarters;

- Certificate of registration from the Central Registry of Economic Entities for domestic, or proof of registration by the competent authority of the home state for foreign entities;

- VAT registration certificate;

- Authorization to represent the bidder;

- Offered lease amount expressed in euros;

- Proof of the paid deposit amounting to 10% of the bid value.

Documents must be submitted in original or certified copy, not older than 6 months, and in the language officially used in Montenegro.

Bids received after the deadline set in the Public Call, bids that do not contain the lease amount or contain a lease amount lower than the starting amount, as well as offers from bidders who have not paid the deposits, are considered invalid.

Ranking and evaluation of bids are based on the criterion – offered lease amount:

- Criterion offered lease amount .......... 100 points

The commission conducts ranking of bids that are deemed formally correct and financially and overall acceptable and establishes a ranking list.

The highest offered lease amount is valued with the maximum number of points, and the scoring of other bids is determined proportionally in relation to the highest offered lease amount.

The deadline for the commission to make a decision is 5 days from the day of opening the offers.

Participants in the Public Tender have the right to object to the commissions decision within 5 days from the day of receiving notification of the results of the Public Call. The commissions decision on the objection is final.

With the most favorable bidder, a lease agreement will be concluded.

If the top-ranked bidder refuses to sign the lease agreement within 8 days from the day the invitation to sign the contract is sent, the University of Montenegro retains the deposit and invites the second-ranked bidder to conclude the contract.

The commission will declare the Public Call unsuccessful if the ranked bidders refuse to sign the lease agreement within the given period. The commission will also declare the Public Call unsuccessful if no bidders apply to the Public Call.

The lessee does not have the right to sublease the land that is the subject of the public call.

Tender rules are published on the University of Montenegros website, along with the Public Call.

 

TENDER RULES

 

PUBLIC CALL BY THE UNIVERSITY OF MONTENEGRO

 

01/2024

 

  1. The tender for leasing real estate – land is organized and conducted by a tender commission, appointed by Decision No. 01-1751/1 of April 4, 2024.

 

The commission can make decisions if more than half of its members are present and decisions are made by a majority vote of all members.

 

  1. Legal entities registered to conduct activities for which the property is being leased are eligible to participate in the Public Call.

 

  1. Ranking is based on the criterion of the offered lease amount.

 

The minimum (starting) annual lease amount is set at €2,832.00, excluding VAT.

 

Lease payments are to be made in full within 7 days of contract signing.

 

Bids are evaluated directly in a tender commission meeting using a scoring system based on the established criteria:

 

   - Offered lease amount .............. 100 points

 

 The highest lease amount offered receives the maximum points, with other bids scored proportionally relative to the highest bid.

 

  1. Bids should specify the lease amount for the tender subject.

 

Bids cannot be changed or supplemented after submission and can be withdrawn within three days before the tender deadline.

 

Bidders must pay a 10% deposit of the offer value, and provide proof of this payment with their bid as a mandatory part of the offer.

 

  1. The opening of the bids can be attended by the bidders, their representatives, or proxies, as per the submitted power of attorney.

 

The Tender Committee opens the bids and checks their formal correctness.

 

  1. Bids that are not timely received or formally correct are considered invalid.

 

  1. The Tender Committee ranks the bids that are deemed formally correct and financially and overall acceptable and establishes a ranking list.

 

  1. The deadline for the Tender Committee to make a decision is 5 days from the date the bids are opened.

 

  1. Participants in the tender have the right to object to the decision of the Tender Committee within 5 days from the day they receive notification of the tender results. The decision of the Tender Committee on the objection is final.

 

  1. The Tender Committee will declare the tender unsuccessful if the ranked bidders refuse to sign the lease agreement within the given period. The tender will also be declared unsuccessful if no bidders apply.

 

  1. A lease agreement will be concluded with the most favorable bidder. If the bidder ranked first does not sign the lease agreement, the submitter of the second-ranked bid, or subsequent bidders from the established tender list, will be called to conclude the agreement.
